It is important to keep the following in mind:

  • the property is one of the oldest in the suburb.
  • This stretch of Main road is zoned residential, although a few properties have consent to include small home offices which have minimal  negative impact on the surrounding residential properties. Restaurants and high density dwelling units are NOT allowed.
  • Last year the property was sold to the present owners, and they embarked on extensive alterations without the necessary plans nor  authorization.
  • The MRA made inquiries with the owners, who gave the specific assurance that they would not operate outside the present zoning restrictions, and had no intention of opening or operating a restaurant from there.
  • Despite such assurances, the owners have gone ahead and started operating a large restaurant.
  • They have applied to re-zone the property for use as a restaurant AND for erecting 18 two-bed accommodation units there – much to the   utter disbelief and anger of nearby residents. The proposed development is not allowed in terms of the Regional Spacial Development Framework of the City of Joburg, nor by the Precinct Plan for this region.
  • 113 written objections to the rezoning have been submitted, including from the MRA and the Melville Koppies Management Committee.
  • Increased noise, traffic congestion, an influx of vagrants, car guards and criminals, and an environmental threat to the Koppies (which is  situated across the road) are some of the stated reasons cited by objectors for objectiing. for why this application should not be approved. Many objectors are nearby residents who view this proposed rezoning as a direct threat.
  • The present liquor license application forms an integral part of the owners’ plans. The MRA opposes the proposal.


OBJECTION PROCESS

Those wishing to object must do so in writing, addressed to the Gauteng Liquor Board and not the Melville Residents’ Association

IMPORTANT NOTE:

  • Ensure that you fill in your details correctly and
  • that the objection is signed and dated.

The Liquor Board requires a single copy of the objection (which must be hand delivered to their offices at Matloto House , 2nd Floor 124 Main Street , Johannesburg) however, to confirm receipt it would be prudent to take a second copy with to the Liquor Board and have both copies stamped as received. The second copy is your confirmation that the Liquor Board has received your objection.

The Melville Residents’ Association Committee will also assist the community if 2 copies of the objection are drop off with Melville Postnet (Corner of 1st Avenue & Main road) before 23 November 2016 @ 17:00 , whereby a MRA representative will ensure delivery to the Liquor Board.

Once you have dropped off your objection at Postnet,  please notify the MRA via mra-liquor@ilovemelville.co.za
